By accessing or using the Site or requesting or receiving services from us, you agree to these Terms. If you do not agree, do not use the Site or request services from us.

We provide non-medical and/or medical home care services as described on the Site and in a separate Client Service Agreement. All services are subject to applicable state laws and professional standards.
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally competent to enter into contracts to use the Site or to enter into a Client Service Agreement. If you act on behalf of another person, you represent that you are authorized to act on that person’s behalf and to bind them to these Terms.
When you contact us or complete a lead form you agree to provide accurate, current, and complete information, including full name, email address, and phone number. You authorize us and our authorized partners to use this information to contact you, evaluate care needs, and provide services. You agree to promptly update your information if it changes.
If you supply health or sensitive information, you represent that you have the legal authority to disclose that information to us and authorize us to use it to provide services. Where applicable, we will comply with HIPAA and other relevant laws with respect to protected health information; however, the Site itself is not a replacement for medical advice, diagnosis, or treatment.
Descriptions of services on the Site are informational and illustrative only. The exact scope, type, frequency, and duration of services will be set forth in a written Client Service Agreement and Plan of Care agreed between you and Genesis Elite Care prior to the commencement of services.
All services are provided pursuant to a separate written Client Service Agreement and Plan of Care which will contain the terms specific to your situation, including fees, schedules, and caregiver instructions. Genesis Elite Care reserves the right to modify services for operational, safety, or legal reasons upon reasonable notice. Any material changes to service scope or fees will be communicated in writing and require mutual agreement where required by law.
Fees and payment terms are specified in your Client Service Agreement. Payment methods may include credit card, debit card, ACH, or other accepted methods processed by third-party payment processors.
Client responsibility for payment is determined in the Client Service Agreement. If a third-party payer (including Medicare, Medicaid, or private insurance) is expected to pay for services, you must provide authorization and necessary documentation. You remain responsible for any amounts not covered by third-party payers, including co-pays or deductibles.
We respect your privacy. Our Privacy Policy explains what personal information we collect (including name, email, and phone number), how we use it, with whom we share it, retention periods, and your rights under laws such as CCPA/CPRA, GDPR, and CalOPPA. Please review the Privacy Policy carefully for details on data subject rights and how to exercise them.
By opting in to receive SMS messages from Genesis Elite Care through any web form, phone call, or other medium, you agree to receive text messages from Genesis Elite Care for the following purposes:
The purpose of text messaging from Genesis Elite Care is for appointment reminders, scheduling confirmations, service updates, care-related alerts, billing notices, and customer care messages.
We utilize third-party service providers (e.g., payment processors, background-check vendors, scheduling platforms, and marketing/analytics providers). These vendors process data on our behalf and are under contract to protect your information. We are not responsible for the privacy practices or security of third parties beyond our contractual obligations. Links to third-party websites do not imply endorsement.
All content on the Site (text, graphics, logos, images, software, and site design) is owned or licensed by Genesis Elite Care and is protected by copyright, trademark, and other intellectual property laws. You may access Site content for personal, non-commercial use only. You may not copy, reproduce, modify, republish, upload, post, transmit, or distribute Site content without our express written permission.

THE SITE, SERVICES, AND CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GENESIS ELITE CARE, ITS AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNTS YOU PAID US FOR SERVICES DURING THE 12 MONTHS PRECEDING THE CLAIM (OR $100 IF NO PAYMENT WAS MADE).
You agree to indemnify, defend, and hold harmless Genesis Elite Care, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your negligence or willful misconduct, or your violation of applicable law.
We are not liable for delays or failures to perform caused by events beyond our reasonable control, including natural disasters, acts of government, strikes, supply chain interruptions, epidemics, pandemics, or other force majeure events. In such cases, we will make reasonable efforts to resume performance as soon as practicable.
These Terms are governed by the laws of the State of Texas without regard to its conflicts-of-law rules. You agree that any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction and venue of the state or federal courts located in Brazoria County, Texas (or Harris County, Texas if jurisdictionally appropriate), and you consent to personal jurisdiction in those courts.
Before filing any lawsuit, you and Genesis Elite Care agree to attempt in good faith to resolve any dispute arising out of or relating to these Terms by informal negotiation. If informal resolution fails, litigation may proceed in the courts identified in Section 20. Each party will bear its own attorneys’ fees except as otherwise provided by statute or court order; however, if a party prevails, the prevailing party may recover reasonable attorneys’ fees and costs to the extent allowed by law.
We may modify these Terms at any time by posting the updated Terms on the Site with a new Effective Date. If we make material changes, we will provide notice as required by law (for example, via prominent posting on the Site or direct communication). Continued use of the Site or our services after the Effective Date constitutes acceptance of the updated Terms.
We may suspend or terminate access to the Site, and we may refuse or discontinue services, at any time for any reason, including for violation of these Terms or unsafe conditions. Termination does not relieve you of payment obligations incurred prior to termination.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The failure to enforce any right is not a waiver. You may not assign these Terms without our prior written consent; we may assign or transfer these Terms in whole or in part without restriction.
These Terms, together with the Privacy Policy and any applicable Client Service Agreement, represent the complete agreement between you and Genesis Elite Care regarding the Site and our services and supersede all prior understandings.
